Achieve a Peaceful Divorce Settlement through Mediation

Mediation is a positive alternative to court litigation that enables people to work out the details of a divorce settlement in a peaceful, cooperative way. 

There are many ways of handling a divorce including arbitration, mediation, and litigation.  Generally, people try to avoid litigation because it can take more time, is more expensive, and can be an emotional roller-coaster.  Unfortunately, in cases when mediation efforts fail and both parties cannot come to an agreement, litigation may become necessary.  However, if there is a way for both parties to come to an agreement out of court, mediation is generally preferred.  Your divorce attorney will work with you through the mediation process.

What does Mediation Entail?

Mediation is a popular alternative to litigation or may be used in combination with litigation.  During the mediation process, a neutral third-party oversees the discussion and agreement process.   The mediator does not act as a judge, but will help facilitate and move the discussions forward towards a resolution.  Discussions are kept confidential and all parties involved are encouraged to work towards compromise and resolution.  It allows participants to air their own opinion and perspective while seeking to diffuse hostility.

A certified mediator is generally an attorney, but will not provide legal advice during the mediation and will not make legal conclusions regarding the merit of either party’s claim.  Once an agreement is reached, both parties will put together a written contract which becomes binding once signed.  In this way, couples can settle divorce issues out of court and avoid the expensive and lengthy process of court litigation.

During divorce mediation, the goal is for both partners to work out the details of their divorce settlement with the assistance of their divorce attorney.  This may include creating a parenting plan, dividing assets, and addressing other issues.  The process may take different amounts of time depending on how amicably both individuals can communicate and how quickly they can reach an agreement.

Where to Begin?

To begin the mediation process, both parties should sign a pre-mediation contract which includes agreements regarding:


  • Mediation confidentiality
  • Choice of mediator and payment of mediator
  • An agreement to mediate in good faith until one or the other party feels they have reached an impasse or feel further discussion is not worthwhile

Once this agreement has been entered into, your attorney should contact the mediator and schedule the session.
