What does child custody involve?

Child custody is a term used to describe the legal relationship between a parent and child. This includes the responsibilities of the parent to care for the child or make important decisions on their behalf. Child custody will also refer to where the child resides and whom they have contact with.

Who is given custody?

Child custody is generally given to the parent who is deemed most capable of providing care in the best interest of the child. In Michigan there are several factors taken into consideration to determine what is in the child’s best interest. In some cases, parents will dispute the decision citing physical, emotional, or sexual abuse on the part of the other parent, or may take steps to prevent contact from the other parent. In such cases, a qualified family law attorney can take the necessary steps to ensure accurate information is provided in court.

According to recent studies, over fifty percent of divorce cases grant primary care of the child to the mother. However, current trends may be increasing the contact fathers have with children following a divorce. One of these trends includes setting up customized parenting schedules.

Custody Trends – Parenting Schedules

In most cases there is a parenting schedule. In these situations, there is less distinction between custodial and non-custodial parents. Rather, each parent is given specific times to care for the child depending on the best interest of the child. In some cases, children spend long periods of time with one parent then long periods of time with another parent. Or, they may spend shorting periods of time with one parent more frequently.
